Terms and Conditions of HKIA VIP Lounge User
Please read these Terms and Conditions carefully before using HKIA VIP
Lounge. By using the HKIA VIP Lounge service, you agree that you have read
these Terms and Conditions and that you accept and agree to be bound by
them.

Definition
Defined terms used in these Terms and Conditions shall have the same
meaning as the terms used in the
Terms and Conditions for Booking HKIA VIP Lounge. Where the same terms are defined separately in these Terms and
Conditions, the meaning given to them in this Clause shall prevail when
construing these Terms and Conditions.

“Ad-hoc Service” means any additional service item(s)
ordered by a VIP or a Companion while he/she uses the Lounge.
- 1.2

“Airline” means the air carrier which the VIP travels
with via HKIA.
- 1.3
-
“Airport”, or “HKIA” means Hong Kong
International Airport.
- 1.4

“Authority”, “AA”,
“we”, “our” or “us”
means Airport Authority Hong Kong, a body corporate validly existing
by virtue of the Airport Authority Ordinance, Cap 483, Laws of Hong
Kong Special Administrative Region ("Hong Kong").
- 1.5

“Booking” or “Confirmed Booking”
means a Booking Request confirmed by the Authority, by which the
Applicant will receive a confirmation via the email address provided
by the Applicant.
- 1.6

“Booking Request” means the request submitted by, or
on behalf of, the VIP (and his/her Companion) to the Authority for the
provision of Service.
- 1.7

“Business Partner” means the Authority’s business
partner and its employees authorised by the Authority to provide
service to VIPs and their Companion(s).
- 1.8

“Companion” means a HKIA VIP Lounge user who is not a
passenger but accompanies a VIP to HKIA VIP Lounge and uses part of
the Service.
- 1.9
-
“Law Enforcement Agencies” or “LEA”
means any or all of the Hong Kong Police Force, Customs and Excise
Department and Immigration Department of the Government of the Hong
Kong Special Administrative Region, as the context may require.
- 1.10

“Lounge” means the physical premises and facility of
HKIA VIP Lounge where majority of the Service is delivered to VIPs.
- 1.11

“Passenger Handling Agent” or “PHA”
means the passenger/baggage handling agent and its staff appointed by
Airlines.
- 1.12

“Pre-booked Service” means the Service and Add-on
Service item(s) ordered before the Lounge visit.
- 1.13
-
“Service” means the standard all-inclusive HKIA VIP
lounge service provided to VIPs and their Companion(s) by the
Authority, which includes departing and arrival flight facilitation
service, selected food and beverage, amenities, facilities in the
lounge and tarmac transfer service, except the airport processes
referred to in the below Role of the Authority section.

“Staff” or “Service Team” means the
employees of the Authority providing services for HKIA VIP Lounge.
- 1.15

“Website” means the official website of HKIA VIP
Lounge including the self-service booking platform.
- 1.16
-
“VIP” means the HKIA VIP Lounge user who is a
departing or arriving passenger of Hong Kong through HKIA.
- 1.17
-
“You” means the person who uses the HKIA VIP Lounge.

Role of the Authority
- 2.1
-
The Authority merely operates the Lounge and facilitates various
airport processes such as check-in for boarding, security screening,
immigration and customs clearance. The Authority however does not
handle these processes:
- 2.1.1

Flight and baggage related services which are carried out by
Airlines or their Passenger Handling Agents;
- 2.1.2
-
Departure and arrival immigration process which is carried out by
Hong Kong Immigration Department;
- 2.1.3
-
Customs clearance process which is carried out by Hong Kong
Customs and Excise Department;
- 2.1.4
-
Security checking service which is carried out by Aviation
Security Company Limited;
- 2.1.5
-
In-lounge shopping service and sales activities which are carried
out by the Authority’s Business Partners; and
- 2.1.6
-
In-town transportation service which is carried out by the
Authority’s Business Partners.
- 2.2

Since the Authority is not a party involved in any of the above
airport process, the Authority disclaims any liability, loss or
inconvenience which you may sustain, suffer or experience as a result
of any decision or action made or taken by any of the parties
concerned. You are advised to raise any inquiries or disputes
regarding these processes with the relevant parties.

Admission to the Lounge (applicable to Companions only)
- 3.1

Before admission to the Lounge, our Staff will ask you to present your
Booking information and identification documents.
- 3.2

A Companion will only be admitted to the Lounge if he/she is
accompanied by a VIP who has secured a Booking. If the VIP does not
show up at the Lounge, this will be regarded as a no show of the VIP
and no refund shall be made by the Authority for the relevant Booking.

Provision of Service for Departure VIP
- 4.1

You are advised to arrive at the Lounge with your checked luggage no
less than ninety (90) minutes prior to the scheduled flight departure
time to allow sufficient time for flight facilitation process by
Airlines, PHA and LEA.
- 4.2

Upon your arrival at the Lounge, you will be asked to present your
Booking information (which is stated in your confirmation email). To
enjoy exclusive services offered to specific groups of users, you may
be required to present additional identification document.
- 4.3

You will need to provide your travel document(s), air ticket(s),
baggage and health documentation for subsequent check-in for your
flight. Additional information may be required by individual Airlines
and PHA. You are solely responsible for ensuring these travel
documents and information meet the requirements of the Airline and/or
PHA, and if applicable, your transit airport and/or the relevant
government authorities of your destination port. The Authority shall
accept no responsibility in this aspect.

After checking-in for your flight, you are welcomed to use the Lounge
and the Pre-Booked Service listed in your Booking. In addition to the
Pre-Booked Service, you may order other Ad-hoc Service if you wish.
- 4.5

When the departure time approaches, our Staff will accompany you to
the departure area in the Lounge for security clearance and
immigration clearance before entering the restricted area. After that,
our Staff will lead you to the boarding gate or the parking bay of the
flight by means of VIP vehicles before the boarding time.
- 4.6

In the event that the flight is delayed after you arrive at the
Lounge, we will use our best endeavours to accommodate your prolonged
use of the Lounge. However, such accommodation may not always be
feasible and it is possible that Ad-hoc Service charge may be
incurred.

Provision of Service for Arrival VIP
- 5.1

Upon your arrival at HKIA, our Staff will greet you at the arrival
gate or beside the aircraft. Upon verification of your Booking
information, we will escort you to the Lounge by a VIP vehicle.
- 5.2
-
At the arrival area of the Lounge, you will need to present your
travel document(s) and baggage reclaim tag(s) for immigration
clearance, baggage retrieval and customs clearance. Clearance
processes may be delayed if you cannot provide the required documents.
- 5.3

If you do not wish to wait for your checked baggage at the arrival
area of the Lounge, you may go through customs clearance with your
hand-carry baggage first, and wait for your checked baggage at the
resting area of the Lounge. However, you will not be allowed to leave
the resting area of the Lounge until your checked baggage is cleared
by the officers of the Hong Kong Customs and Excise Department
(two-step customs clearance process). This two-step customs clearance
process is offered at the sole discretion of the officers of the Hong
Kong Customs and Excise Department. Upon request by the officers of
the Hong Kong Customs & Excise Department, you may need to go
through customs clearance again with your checked baggage.

During your waiting time at the resting area of the Lounge, you are
welcomed to use the Lounge and Pre-booked Service listed in your
Booking. In addition to the Pre-Booked Service, you may order Ad-hoc
Service if you wish.
- 5.5

In the event that your arrival flight is delayed, we will use our best
endeavours to accommodate your delayed use of the Lounge. However,
such accommodation may not always be feasible and extra Ad-hoc Service
charge may be incurred.

Ad-hoc Service
- 6.1
-
While you are at the Lounge, you may order Ad-hoc Service if you wish.
Payment for Ad-hoc Service is in addition to the Service charge for
the Pre-Booked Service. We accept payment by Visa, MasterCard,
American Express, UnionPay, Alipay, Alipay(HK) and WeChat Pay for
Ad-hoc Service. Payment by cash is not acceptable.

All prices are for Ad-hoc Service are listed in Hong Kong Dollars
(HKD).

Lounge Rules and Regulation
- 7.1
-
To use the Lounge, VIPs or Companions who are aged 11 or below must be
accompanied by other VIPs or Companions who are aged 18 or above.
Alcoholic drinks at the Lounge will not be provided to VIPs or
Companions under the age of 18.
- 7.2
-
In order to preserve the privacy and confidentiality of VIPs and their
Companions, all VIPs and Companions must conduct themselves in an
appropriate manner including not disturbing other Lounge users, or
disclose the presence of particular Lounge users to any third party.
- 7.3
-
All VIPs and Companions shall ensure that they are at all times
appropriately dressed. The Authority reserves the right at its sole
and absolute discretion to refuse entry or to dismiss any VIP or
Companion whose behaviour or attire is considered inappropriate by our
Staff or is likely to offend other users.
- 7.4

It is the responsibility of each VIP to ensure that he/she is fit for
his/her flight and meets all requirements of the Airlines following
consumption of alcohol at the Lounge. We accept no responsibility or
liability for VIPs who are denied boarding by the Airlines.
- 7.5

The following activities are not permitted in the Lounge area:
- 7.5.1
-
Holding of gatherings, events, demonstration, speeches or touting
activities unless such is authorised by the Authority and/or our
Staff;
- 7.5.2
-
Engaging in unsafe act, or any other act which may impede the
operation of the Lounge or damage any of the Lounge facility;
- 7.5.3
-
Becoming intoxicated, whether or not as a result of consumption of
alcohol served at the Lounge;
- 7.5.4
-
Acting in an aggressive, rude, abusive or threatening manner
towards any person present at the Lounge;
- 7.5.5
-
Bringing of animals into the Lounge (except for guide dogs
accompanying persons with sight disability);
- 7.5.6
-
Smoking of cigarettes, pipes or cigars (including electronic
cigarettes); and
- 7.5.7
-
Using the Lounge for any unlawful purposes or in any inappropriate
manners.
If any person is found to be in breach of any of the provisions set
out in Clause 7.5, the Authority may take any action as it thinks fit
including without limitation dismissing such person from the Lounge.

Refund Policy
- 8.1

- 8.2

The Authority shall have the sole and absolute discretion in
determining applications for refund.
- 8.3
-
Without prejudice to the generality of Clause 8.1, the Authority shall
review applications for refund on a case-by-case basis for the
following scenarios:
- 8.3.1
-
Where part of the Pre-Booked Service cannot be fulfilled due to
uncontrollable and/or unforeseeable factors;
- 8.3.2
- Where the VIP is denied boarding or landing; or
- 8.3.3
-
Where the VIP is under investigation and has been taken into
custody by the LEA.
- 8.4
-
Refund shall be made by the Authority through the same channel or
medium used in payment for the Booking.

Liability
- 9.1
-
We shall not be liable to the VIP or his/her Companion for any loss or
damage caused to or suffered by the VIP or his/her Companion as a
direct or indirect result of:
- 9.1.1
-
Our provision or non-provision of the Lounge or any of the
Services (including Pre-Booked Services and/or Ad-hoc Services);
or
- 9.1.2
-
Any delay in provision of any of the Services (including
Pre-Booked Services and/or Ad-hoc Services)
by reason or any circumstances that are not foreseeable or beyond our
control.
- 9.2
-
To the fullest extent permitted by law, our maximum liability arising
from:
- 9.2.1
-
Our provision or non-provision of the Lounge or any of the
Services (including Pre-Booked Services and/or Ad-hoc Services);
or
- 9.2.2
-
Any delay in provision of any of the Services (including
Pre-Booked Services and/or Ad-hoc Services)
shall be capped at the amount of payment actually received by the
Authority in respect of the relevant Pre-Booked Service (and Ad-hoc
Service if applicable).
- 9.3
-
We shall under no circumstances be liable or responsible for any
theft, loss or damage to personal belongings brought into the Lounge
by any VIP or his/her Companion. VIPs and Companions shall take care
of their personal belongings at all times.
- 9.4
-
All information or recommendation given by or on our behalf regarding
the Airport services or flight details is for your information only.
We shall not be liable if such information or recommendation is
inaccurate, outdated or is considered unsuitable due to any reason.
- 9.5
-
For departure VIPs, we shall not be liable if you are late in arriving
at the Lounge resulting in the Airlines’ and/or their PHAs’ refusal to
accept you and/or your luggage for the flight.

Indemnity
- 10.1
-
You hereby agree to indemnify and hold the Authority, its officers,
employees, agents and contractors harmless against all damages,
losses, costs (including legal costs), expenses and liabilities
suffered or incurred arising out of your use of:
- 10.1.1
- The Lounge;
- 10.1.2
-
Any facilities or any Services (including Pre-Booked Service or
Ad-hoc Service) at the Lounge; and/or
- 10.1.3
-
Your failure to act in accordance with these Terms and Conditions.

Data Protection
- 11.1

By using the Lounge and Service, you agree that we can store, process
and use the personal data you provide during your admission into the
Lounge, and during your use of the Lounge, for fulfillment of the
Service.
- 11.2
-
We are committed to safeguarding the privacy of all individuals with
respect to their personal data. We therefore make sure that our
policies and practices in relation to the collection, use, retention,
transfer and access of personal data comply with the requirements of
the Personal Data (Privacy) Ordinance (Chapter 486) under the laws of
Hong Kong. For information about our treatment of personal data,
please refer to our
Privacy Policy.

General
- 12.1

In case of any dispute between the parties in respect of or in
connection with these Terms and Conditions, our determination shall be
final and binding.
- 12.2
-
The rights and remedies provided in these Terms and Conditions are
cumulative and not exclusive of any rights or remedies provided by
law.
- 12.3
-
No waiver of any breach of these Terms and Conditions shall be
effective unless made in writing by the party granting such waiver.
- 12.4
-
No failure by us to enforce at any time or for any period any one or
more of these Terms and Conditions shall be a waiver by us of the
right at any time subsequently to enforce any or all of these Terms
and Conditions.
- 12.5

You shall not assign or transfer your rights or obligations under
these Terms and Conditions or any part, interest or share herein
without our prior written consent.
- 12.6

If any provision of these Terms and Conditions is declared by any
judicial or other competent authority to be void, voidable, illegal or
otherwise unenforceable, the parties shall amend that provision in
such reasonable manner so as to achieve the intention of the parties.
Alternatively, at our discretion, it may be severed from these Terms
and Conditions and the remaining provisions of these Terms and
Conditions shall remain in full force and effect, unless we (at our
discretion) decide that the effect of such declaration is to defeat
the original intention of the parties.

These Terms and Conditions shall be governed by the laws of Hong Kong
and both you and the Authority agree to submit to the exclusive
jurisdiction of the Hong Kong courts.
- 12.8

We may revise these Terms and Conditions at any time without prior
notice. Any change made to these Terms of Conditions will be posted on
this Website. Your continued use of this Website after any such
posting amounts to your conclusive acceptance of the revised Terms of
Conditions. If any dispute arises, our determination shall be final.
- 12.9

Where these Terms and Conditions are available in other languages, the
English version is the governing version and shall prevail.
